§ 1 Scope of Application
These General Terms and Conditions ("GTC") apply to the use of the AdWise App and the website adwise.care. They govern the contractual relationship between mens care + life GmbH ("MCL") and the user of AdWise services in the version valid at the time of the respective conclusion of the contract. These GTC apply, subject to amendments pursuant to § 15, for the entire duration of the contract.
The use of the AdWise App and the associated services requires that users agree to these GTC. The user declares their consent by clicking the corresponding consent field. The text of these GTC in the currently valid version can be accessed at any time on the website adwise.care and in the AdWise App.
Conflicting, deviating or supplementary general terms and conditions of the user shall not become part of the contract unless AdWise expressly agrees to their validity. This also applies if AdWise performs services without reservation in full knowledge of conflicting or deviating general terms and conditions of the user.
§ 2 Services of AdWise
MCL operates an online platform at the URL adwise.care, which provides free information on fitness, health and a healthy lifestyle and offers a free download of the AdWise App. The free download of the AdWise App enables users to access a limited number of free AdWise content items. These consist of general descriptions of individual blood parameters and their reference ranges, as well as preparations such as dietary supplements from third parties. The content of the AdWise App provides information on the topics of health, longevity and well-being. It does not replace advice or treatment by a licensed physician and cannot substitute for such consultation.
In addition to the limited number of free AdWise content items pursuant to § 2(1), users are provided with the option to book further paid services for a fee in the AdWise Web Shop and in the AdWise App (booking a one-time “PURE” package or concluding a paid AdWise ESSENTIAL subscription). These paid services include:

MCL does not provide medical services itself. Users are referred via the MCL-operated platform to service providers and partners who independently provide the medical services. Users can purchase services (paid tests and paid preparations) from cooperating third-party providers through the AdWise App or the Web Shop, with whom the user concludes an independent contract.
The blood tests are offered by independent medical cooperation partners, and the blood analyses are evaluated by external specialist laboratories. The various blood tests differ in the number of values/biomarkers to be tested (e.g. hormones, vitamins, minerals, antibodies, enzymes). An overview of the available services including prices can be found in the AdWise App and on the AdWise website.
Users are referred to the selected AdWise partners to access the booked services. The cooperation partners provide the appropriate information for the booked service.
In the case of a blood test, the blood draw is carried out at home and the facility or specialist laboratory evaluates the blood sample of the respective blood test. With the user's consent, AdWise makes the test results available to users in the AdWise App.
§ 3 Conclusion of Contract
Upon account creation in the AdWise Web Shop or after downloading and registering in the AdWise App, a contract for the use of these platforms is concluded between MCL and the user. By booking a service through the AdWise Web Shop and/or the AdWise App, the user declares that they wish to have the selected service carried out.

By booking and purchasing the blood test, the user declares that they are personally responsible for performing the blood draw. The user is also responsible for sending the blood sample to the AdWise cooperation partner or laboratory responsible for performing the blood analysis and preparing the test result. The terms and conditions/GTC of the respective third-party provider apply to the performance of services by these third-party providers.
By booking and purchasing the tests, the user expressly authorises MCL to conclude a contract on their behalf with the external laboratory cooperating with AdWise that performs the analysis. The contractual partner for conducting these analyses is the ISO-certified laboratory network of Homed-IQ Europe B.V., Mensinge 2, 1083 HA Amsterdam (Netherlands).
By clicking the "Buy now" or "Order with obligation to pay" button, the user submits a binding offer to MCL for the conclusion of a contract incorporating these GTC and undertakes to pay the fee for the respective service. MCL accepts this offer by sending an order confirmation by email. Prior to submitting the order, the user is shown all mandatory pre-contractual information in accordance with Art. 246a § 1 EGBGB.
By booking and/or purchasing, the user confirms that they are of legal age and that the performing third-party providers are authorised to provide the services (e.g. blood test, preparations).
With regard to the user's rights of withdrawal, the provisions of § 3a of these GTC apply.
The AdWise cooperation partners have the right to exclude users from the further performance of the contract if this is not possible for medical reasons (e.g. insufficient blood volume obtained).
The provision of laboratory results in the AdWise App is carried out by the company Homed-IQ Europe B.V., Mensinge 2, 1083 HA Amsterdam (Netherlands) (please refer to our Privacy Notice at adwise.care/privacy for further details). This function can be used without restriction by users with an AdWise ESSENTIAL subscription. Users without an AdWise subscription have limited access to this function (see § 7(2)).
§ 3a Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded (for services and digital content) or from the day on which you or a third party designated by you, other than the carrier, took possession of the last goods (for goods such as test kits).
To exercise your right of withdrawal, you must inform us – mens care + life GmbH, Mauerkircherstrasse 93, 81925 Munich, email: info@mens-care-life.com – by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form set out below, although this is not obligatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Expiry of the Right of Withdrawal for Digital Content and Services
The right of withdrawal expires for a contract for the supply of digital content (such as access to the AdWise App, Scanning function) not supplied on a tangible medium where MCL has begun performance of the contract after you have:
expressly consented to MCL beginning performance before the end of the withdrawal period, and
confirmed your acknowledgement that you will lose your right of withdrawal once performance of the contract has begun with your consent.

§ 4 Analysis Results and Display of Laboratory Results
As soon as MCL receives the test results from the external laboratory, MCL makes these available to users in their personal accounts. MCL notifies users by email and, if enabled, by push notification.
The laboratory report of the external specialist laboratory is made available via the AdWise App. The service of MCL is limited to providing the laboratory report. MCL does not offer further consultation, diagnostics or consultations based on the results of the report. It is the sole responsibility of users to respond to the results and, if necessary, to consult a physician or hospital.
Users acknowledge that the testing services are not a substitute for medical advice/treatment. Users suffering from an illness should consult their physician or treatment provider before using the AdWise services.
§ 5 Registration and Technical Requirements
The use of AdWise services, including the booking and/or purchase of services, requires registration in the AdWise App. This requires the entry of a valid mobile phone number and a valid email address, as well as consent to these GTC by clicking the corresponding consent field.
The use of the AdWise App requires the mobile operating system iOS (minimum version 13.0) or Android (minimum SDK version 28). The download of the AdWise App is also required in order to receive the results of services. The app is interoperable with the currently supported operating system versions; technical protection measures (e.g. data encryption, access security) are described in the Privacy Notice.
The use of the services offered and brokered via the platform requires the user to register via the website adwise.care or the AdWise App. To identify the user for the use of the offered services and to prevent misuse, registration is required, during which the user must provide their full name, email address and date of birth.
The user is solely responsible for ensuring the security of their account. In the event of suspected unauthorised use or misuse of the account, the user is obliged to inform MCL immediately.
§ 6 User Obligations and Truthful Information
The content of the AdWise App may only be used or reproduced for personal and not for commercial purposes. Sharing content without the express consent of MCL is prohibited.
Registration and use of the services on the platform are permitted exclusively to natural persons acting in their own name. The minimum age for using the platform is 18 years; legal age must be confirmed during the registration process. Registration in the name of third parties is not permitted and will result in immediate exclusion from use of the platform. Should it be determined that an account was not created in the user's own name or that any other form of misuse has occurred, all contractual relationships between MCL and the user may be terminated with immediate effect without further notice or explanation.
§ 7 Prices and Payment Terms
The amount of the fees for the various AdWise services (one-time bookings for services and AdWise subscriptions) can be accessed via the AdWise App or the AdWise website in the current version. All prices are final prices inclusive of the applicable statutory value added tax.
MCL collects the fees for the paid services in its own name. The following AdWise subscription and booking models are available:
1 x PURE package (one-time booking, free of charge)
1 x ESSENTIAL per month (subscription)
Each subscription enables unlimited display of test results. Users without an AdWise subscription have limited access to this function.
AdWise users can contact AdWise customer service at any time for information about subscriptions and services.
For the laboratory diagnostic services of the external specialist laboratory and/or cooperating partners, MCL, with the user's express consent, collects the fee on behalf of the laboratory in accordance with the fee schedule agreed between MCL and the laboratory. These fees are already included in the service or subscription prices and are not invoiced to the user separately. Upon full payment to MCL, the user settles the invoiced claims in full.
Payment is made upon booking and/or purchase of services via the AdWise App or web platform by credit card. Further payment methods may be offered during the ordering process.
The invoice will be sent by email.
§ 8 Availability and Modification of Services, Updates
The services offered in the AdWise App are generally available 24 hours a day. Exceptions are periods during which data backup operations are carried out and system or programme maintenance work is performed on the system or database. MCL will keep any disruptions resulting from this to a minimum.
MCL is entitled to modify the services offered in the App if such modification is necessary to adapt the service offering to a new technical environment or an increased number of users, or for other important operational reasons, due to legal changes or due to changes in organisational processes. In the case of material changes that could affect your contractual rights, MCL will inform users in good time before such changes come into force and will grant users a right of termination free of charge.
MCL will provide, during the term of the contract, those updates and security updates that are necessary for the use of the offered services. AdWise will inform users promptly after the provision of such an update. If the update is not installed within 14 days of notification, MCL shall not be liable for product defects that are solely attributable to the absence of the update.
§ 9 Referral Programme
MCL offers a referral programme. Existing users ("Referrers") who recommend friends or family members as new users of the AdWise service may be eligible to receive referral credits ("Credit(s)").
The new user must register using the personal, unique code ("Code") provided to them by the Referrer. The code must be provided to the user via email, text message, or via the "Share your code" option in the AdWise App. Unless otherwise agreed between MCL and the Referrer, the Referrer is not permitted to publish the personal code on publicly accessible websites (including coupon websites), place paid advertisements, spam unknown individuals, or otherwise present the offer in a manner that misrepresents the relationship with MCL. MCL reserves the right to determine whether a referral qualifies for credits, and may deactivate or invalidate credits obtained through the above-mentioned or similar methods.
Restrictions may apply to the number of credits a Referrer can receive. Such restrictions will be specified in the AdWise service where applicable. Referrers can only receive credits from users located in the same country as the Referrer. The amount of credits varies by region and is indicated in the Referrer's AdWise account and in the offer received by the user. MCL reserves the right to withhold or invalidate credits if they were obtained through error, fraud, illegal activity or in violation of these terms.
These terms of the referral programme apply to all users, unless expressly agreed otherwise in writing between MCL and a user.
§ 10 Cancellation / Account Closure
The minimum term of a paid subscription is 3 months. Thereafter, the subscription renews automatically by one further month at a time, unless cancelled with 4 weeks' notice before the end of the respective current billing period. The maximum binding period is 24 months. The user can cancel the subscription via: App → Settings → "Subscription details" or by email to: info@mens-care-life.com.
The right to extraordinary termination for good cause remains unaffected for both parties. Good cause for MCL exists in particular if the user, despite a reminder, remains in arrears with due payments, breaches essential contractual obligations, or has provided false information during registration.
If the user no longer wishes to use the free services of MCL, they can close their user account at any time via the "Settings" option in the AdWise App or on the website. Upon closure, the user's account will be immediately and permanently deactivated and will no longer be accessible online.
The closure of the account with MCL results in deactivation of access and complete deletion of the user's data in accordance with the Privacy Notice. Health data and laboratory results already stored will, upon the user's request, be exported beforehand in a common format (e.g. PDF). Further information on data processing can be found in our Privacy Notice at adwise.care/privacy.
In the event of cancellation or account closure, services already paid for in full and booked will still be rendered to the extent technically possible. A pro-rata refund of subscription fees already paid will be made for the unused period on a pro-rata temporis basis.
§ 11 Data Processing
AdWise processes user data with consent in accordance with the Privacy Notice, which is available at adwise.care/privacy. The privacy notices of the respective third parties also apply to the processing of personal user data in the context of fulfilling the aforementioned contracts with third parties.
Insofar as health data (special categories of personal data within the meaning of Art. 9 GDPR) is processed in the context of the use of the AdWise App, this is carried out exclusively on the basis of the user's explicit and separate consent pursuant to Art. 9(2)(a) GDPR, which is obtained during registration. Consent may be withdrawn at any time with effect for the future.
§ 12 Liability
Liability of AdWise and its vicarious agents for slight negligence is excluded, unless otherwise stipulated below.
Excluded from the limitation of liability for slight negligence set out in para. 1 above are claims for damages by the user resulting from injury to life, body or health, as well as claims for damages arising from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfilment is a prerequisite for the proper performance of the contract and on whose compliance the contractual partner regularly relies and may rely. In the event of a breach of essential contractual obligations, however, liability is in principle limited to the damages typical for the contract and foreseeable at the time of conclusion.
In all other respects, liability is governed by the general statutory provisions; in particular, the provisions of the Product Liability Act in its currently applicable version (strict liability, including digital products and software) remain unaffected.
AdWise assumes no liability for errors or omissions of the third-party providers referred to in § 3(4), to whom AdWise establishes contact via its platform and with whom the user enters into independent contractual relationships. AdWise's liability for its own fault in the selection and monitoring of these third-party companies (liability for selection errors) remains unaffected.
§ 13 Warranty Rights for Digital Content and Services
The statutory warranty rights pursuant to §§ 327 et seq. BGB (contracts for digital products) apply to the digital content and services provided by MCL (in particular access to the AdWise App and display of laboratory results).
If a digital content item or digital service does not meet the contractual requirements (defect), the user is entitled to remedy. If remedy fails or is unreasonable for MCL, the user may reduce the contract price or terminate the contract and claim damages in accordance with § 12.
Commercial users are entitled to the statutory warranty rights within the statutory limitation periods.
§ 14 Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution, which can be found at http://ec.europa.eu/consumers/odr/. AdWise is neither obligated to participate in dispute resolution proceedings before a consumer arbitration board, nor does AdWise voluntarily participate in such proceedings.
§ 15 Amendments to the GTC
General: The user is subject to the General Terms and Conditions (GTC) that are in force at the time of use of the AdWise services. AdWise reserves the right to amend these GTC to the extent necessary and where this does not unreasonably disadvantage the user. Amendments may be made in particular for the following reasons:
Adaptation to statutory or regulatory requirements
Improvement of the security of the AdWise services
Further development or optimisation of existing functions
Introduction of new functions
Necessary technical adaptations to ensure the functionality of the AdWise services
Notification obligation and right to object: AdWise will inform the user by email of intended amendments to the GTC that do not exclusively change their rights and obligations to their advantage, at least six weeks before they come into force. In this notification, AdWise will explain the planned amendments clearly and comprehensibly and highlight the affected clauses. The user has the right to object to the amended GTC within six weeks of receiving the email.
⚠️ Important notice: If you do not object to the amended GTC, your silence after the expiry of the deadline will be deemed as consent to the amended GTC. You may terminate the contract at any time without observing a notice period up until the amended GTC come into force. MCL will explicitly draw attention to this information in the announcement email.
Right of termination in the event of objection: Should the user object to the amended GTC, AdWise reserves the right to terminate the contract with a notice period of two weeks if continuation of the contractual relationship under the old conditions is unreasonable for AdWise. This is particularly the case if the amendments are absolutely necessary due to new statutory requirements, regulatory obligations or for economic reasons. AdWise will set out the reasons for the unreasonableness in the notice of termination. Services already booked and paid for will still be rendered under the old conditions in such a case.
Amendments to the AdWise Services: Notwithstanding the above provisions, AdWise reserves the right to make non-material adaptations to the AdWise Services (e.g. adaptations to the user interface, visual changes) at any time in order to improve functionality, security and user-friendliness. Material changes to services are subject to the notification obligations pursuant to para. 2.
§ 16 Final Provisions
The contractual relationships between the user and AdWise are governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is, to the extent permitted, Munich. The mandatory consumer protection provisions of the state in which the user as a consumer has their habitual residence remain unaffected.
The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Should individual provisions of these GTC, including this final provision, be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid or missing provisions shall be replaced by the respective statutory regulations.
