The following provides information about the processing of personal data when using our website (adwise.care) and the AdWise App. Personal data means any data that can be attributed to you personally, e.g. your name, address, email addresses, and usage behaviour. This Privacy Notice applies to the processing of personal data under the General Data Protection Regulation (GDPR) of the European Union, as well as the revised Swiss Federal Act on Data Protection (revFADP) and the associated Ordinance on Data Protection (ODP).
For clarity, the following primarily uses the terminology of the EU GDPR. For persons resident in Switzerland, these details apply mutatis mutandis under the revFADP and the ODP.
1. Controller and Allocation of Responsibilities
The processing of personal data in connection with AdWise services is carried out by various companies, each with different responsibilities:

In accordance with Article 14 of the revised Federal Act on Data Protection (revFADP), mens care + life GmbH has appointed DataRep as its data protection representative in Switzerland.

3. What Data Is Processed and for What Purpose?
3.1 Website and AdWise App
3.1.1 General Website Use

Processing this data is technically necessary to display the website to you and to ensure its stability and security. The Operator also evaluates this information for statistical purposes.

3.1.2 Technically Necessary Cookies
The Operator uses cookies that are necessary for the operation and provision of features. The data collected by these cookies is not used to create user profiles.

3.1.3 Optional Cookies (Statistics and Marketing)
The Operator also uses optional cookies. These are only activated if you have previously consented via the cookie consent tool.
We use Matomo, a self-hosted web analytics platform. Matomo uses first-party cookies only — your data is never shared with third parties.

3.1.4 Contact
If you use the available contact options (e.g. by email), the Operator processes the following data:

The information provided will be stored to process your enquiry and any subsequent correspondence. The data will be deleted once storage is no longer necessary, or processing will be restricted where statutory retention obligations apply.
Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures / performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest in responding to enquiries).
3.1.5 Social Media Plugins
This website uses buttons ("plugins") of various social networks (e.g. Instagram, LinkedIn). By clicking the social media buttons, you consent to the transfer of your data to the respective network. Social media providers based in the USA may have different data protection standards than those applicable in EU member states.
Please note that AdWise is not a provider of social networks and has no influence over the data processing carried out by the respective service providers. Further information about the individual plugins can be found on the websites of the respective operators.
3.1.6 Product Recommendation Questionnaire
If you complete our product recommendation questionnaire on the website, we process your contact details (in particular your email address; and your name where provided) as well as your answers, in order to qualify your enquiry, contact you at your request, and provide you with information about our offerings. The questionnaire is provided via the service provider Lovable; data is subsequently stored in a database in Germany/EU by our processor Supabase.
Legal basis: Your consent pursuant to Art. 6(1)(a) GDPR; you may withdraw this at any time with effect for the future. If you also subscribe to the newsletter via the questionnaire, Section 4 of this Privacy Notice additionally applies.
3.1.7 AdWise App
We offer you the option to purchase individual tests or subscribe directly via our website. To do so, you create an account in order to subsequently access the results in the app. We process the following personal data:
Last name, first name(s)
Email address
Account information
Payment information
Information about the tests
This data is collected to enable you to use our testing and results services. You need an account to purchase tests and securely access your test results.
Legal basis: Art. 6(1)(b) GDPR (performance of a contract).
The processing described above is hosted via Hetzner Online GmbH. Hetzner Online GmbH is a hosting service provider based in Germany. Your personal data collected during the use of our website may therefore be stored on servers in Germany. We rely on a Data Processing Agreement (DPA) pursuant to Art. 28 GDPR.
Once you enter medical data (e.g. in the questionnaire), AdWise processes this under its own responsibility, provided this is solely for the purpose of appointment booking or displaying results. The actual blood collection is carried out under the independent responsibility of the blood collection point referred to in Section 3.2.3.
3.1.7.1 Medical Data in Connection with a Purchase
The Operator (mens care + life GmbH) transmits your master data as an independent controller to the carrying-out partners and/or laboratories. These parties process the data solely for the purpose of legally required documentation.

3.2 Use of the AdWise App
3.2.1 Advertising Tracking on iOS
iOS offers various options to restrict advertising and tracking. Tracking is generally carried out via the so-called "Advertising Identifier" (IDFA). This is a unique, non-personalised and non-permanent identification number for a specific device provided by iOS. The data collected via the IDFA is not linked to other device-related information. We use the IDFA to provide you with personalised advertising and to evaluate your usage.
In the iOS settings under "Privacy", you can largely deactivate advertising evaluation under "Tracking". In addition, you can disable personalised advertising under "Apple Advertising".
Legal basis: Your consent pursuant to Art. 6(1)(a) GDPR in conjunction with Section 25(1) TDDDG. You may withdraw your consent at any time with effect for the future via the cookie consent tool or the iOS settings.
3.2.2 Registration / User Account
In order to book and purchase services available via the AdWise App, it is necessary to set up a user account. This requires the processing of the following master data:
First name, last name
Phone / mobile number
Email address
Legal basis: Art. 6(1)(b) GDPR (performance of the user agreement pursuant to the terms of use deposited during the registration process).
3.2.3 Processing of Services
If you purchase a service via the app (e.g. a blood test), the following data is processed:
Gender
Date of birth
Type of service
Master data of the data subject
Health data of the data subject (such as habits, illnesses, state of health, information about the results of the service provision). For this purpose, we use the third-party tool.
Payment data
The data is transmitted automatically to the partner or the external laboratory. The laboratory transmits the test results exclusively to the Operator (mens care + life GmbH), which displays them in your user account. The display of results in the AdWise App is carried out under the responsibility of mens care + life GmbH.
A laboratory from the ISO-certified laboratory network of Homed-IQ Europe B.V., Mensinge 2, 1083 HA Amsterdam (Netherlands), subsequently transmits the test results back to the operator, who then makes them available to the commissioning person in their respective user account via the AdWise app. The results are available for your review only. Before you can access them in the app, you must identify yourself via a code.
Each service provider listed above is solely responsible under data protection law for their own mandatory documentation (Section 630f of the German Civil Code (BGB) / German Heilpraktikergesetz).
Legal bases: Art. 6(1)(b) GDPR (booking / performance of a contract); Art. 9(2)(a) GDPR (your explicit consent for the receipt and display of laboratory results via the AdWise App).
3.2.4 Secondary Use for Research Purposes
If you have given us your separate consent to do so, we use the results of the services you have requested in pseudonymised form for the conduct of studies and statistical analyses. Your personal data, including health data, is pseudonymised to the extent that traceability back to you is, as far as possible, excluded.
Legal basis: Art. 9(2)(a) GDPR (your separate consent).
3.2.5 Use of Your Photos
If you grant the AdWise App access to your photo library, the Operator will only use this data to provide you with the requested functions (e.g. uploading photos). We do not collect personal data from your photos and do not transfer any of your photos to third parties.
Legal basis: Art. 6(1)(b) GDPR; in the case of health data, additionally your consent pursuant to Art. 9(2)(a) GDPR.
3.2.6 User Profiles
For the purpose of analysing usage, tailoring our services to users' needs, and detecting errors, we create usage profiles if you consent to this when using the mobile app. This data is not combined with other personal data.

3.2.7 User Surveys ("User Research")
If you give us your consent to do so, we conduct user research with you in the form of interviews. For this purpose, we process the personal data stored by you in our app (in particular contact details and information about services used), as well as personal data communicated during an interview (including health data).
Legal basis: Your consent pursuant to Art. 6(1)(a) GDPR and Art. 9(2)(a) GDPR.
3.2.8 Health Questionnaire
As part of the Health Questionnaire conducted during registration, we collect and process various categories of personal data in order to provide you with personalised health information and recommendations. This data includes:
Dietary habits
Physical activity (frequency and type of activities)
Illnesses (current or past)
Addictive behaviour (consumption of alcohol, tobacco or other substances)
Sexual life (habits, frequency and infections)
Emotional states (e.g. stress or general wellbeing)
These sensitive health data are processed in accordance with Art. 9 GDPR and used solely for the clearly defined purposes of analysing and improving your individual health profile. Processing is based on your consent, which you may withdraw at any time with effect for the future.
Please note that providing this information is voluntary. Without it, however, we are unable to offer you personalised health services.
3.2.9 Payment Processing (Stripe)
For payment processing, we use Stripe Payments Europe, Limited (SPEL), 1 Grand Canal Street Lower, Dublin 2, Ireland. Stripe processes your payment data (e.g. credit card details) as an independent controller. Further information can be found in Stripe's Privacy Policy: https://stripe.com/privacy.

3.2.10 Marketing Communications by Email and Push (Brevo, Wonderpush)
If you give us a separate consent for marketing emails and/or push notifications, we use Brevo (for emails) and Wonderpush (for push notifications). Consent can be given separately for each communication channel. We only use health-related data for marketing or personalisation purposes if you have given your separate explicit consent to this.
For mere delivery purposes, we process only the minimum technical data necessary (e.g. email address for emails; push token of the device, language, opt-in status for push notifications). For personalisation within the relevant channel for which you have consented, we may process so-called "user attributes" (such as name, language, region/country) as well as "events" arising from your use of our services (e.g. item added to cart, purchase completed).
Legal basis: Your consent pursuant to Art. 6(1)(a) GDPR; where storing or reading information on your device for non-strictly necessary purposes is required, pursuant to Section 25(1) TDDDG. You may withdraw your consent at any time in the app settings.
Upon withdrawal of consent, we will immediately cease further data collection and use for the relevant channel and will delete or anonymise within 30 days all personalisation data stored for this purpose in Brevo/Wonderpush.
For email delivery and personalisation: Brevo (Sendinblue GmbH, Koepenicker Strasse 126, 10179 Berlin; and/or Sendinblue SAS, France).

4. Newsletter
We offer a newsletter through which we regularly inform you about new developments, offers and recommendations. You will receive the newsletter if you sign up via the newsletter form on our website or if you consent to receiving our newsletter during account creation. In this context, we process in particular your name and email address.

Processing is based on your consent pursuant to Art. 6(1)(a) GDPR. Consent is voluntary and may be withdrawn at any time with effect for the future. Withdrawal does not affect the lawfulness of the processing carried out prior to withdrawal. Description of Data Processing and Purpose
We process your personal data (e.g. salutation, first name, last name, email address) to send you marketing information about our products and services by email. If you have given your consent, we may also process information about your interaction with our marketing emails (newsletter tracking: e.g. open rates, links clicked).

Wonderpush (Wonderpush SAS), 19 rue Michel Lecomte, 75003 Paris, France. Further information: https://www.wonderpush.com/privacy-policy/. Wonderpush acts as our processor for the delivery of push notifications.
Data Processing in Third Countries
Data processing may also take place in countries outside the EU/EEA ("third countries"), such as the USA or Canada. Where an adequacy decision pursuant to Art. 45 GDPR exists for the third country, processing is based on that decision. Otherwise, standard contractual clauses (Art. 46(2)(c) GDPR) and, where applicable, additional measures will be used to ensure an adequate level of data protection.
Retention Period
Your data will be stored for as long as necessary for the stated purposes or until you withdraw your consent. Thereafter, the data will be deleted unless another legal basis exists.
5. International Transfers of Personal Data
Where personal data is transferred to countries outside the European Economic Area, we only transfer it to third countries for which the European Commission has confirmed an adequate level of protection, or in which we can ensure careful handling of personal data through contractual agreements (standard contractual clauses) or other appropriate safeguards. You may request information from us in this regard.
6. Automated Decision-Making
Data from visits to this website or use of the AdWise App is not used for automated decision-making within the meaning of Art. 22 GDPR.
7. Deletion of Data
Unless otherwise stated, the Operator deletes or anonymises your personal data as soon as it is no longer required for the purposes for which it was processed.
Data in the AdWise App is generally stored for the duration of the usage or contractual relationship.
Storage may continue beyond the stated period in the event of (threatened) legal disputes or other legal proceedings.
Third parties engaged by the Operator will store your data on their systems for as long as necessary in connection with the provision of services.
Statutory requirements regarding the retention and deletion of personal data (e.g. Section 257 of the German Commercial Code (HGB), Section 147 of the German Tax Code (AO)) remain unaffected by the above. The laboratory stores its collection documentation independently for at least 10 years (Section 630f BGB); the Operator has no influence over this.

With respect to the Operator, insofar as website, app account, marketing, newsletter or other non-medical data is concerned, you have the following rights:

Please note: If you wish to access medical data, please contact the respective service provider directly. The laboratory (address: see Section 3.2.3) is solely responsible for its mandatory documentation.
9. Changes to this Privacy Notice
We reserve the right to amend this Privacy Notice at any time. The current version is always available on our website. In the event of material changes that could affect your rights, we will notify you separately where appropriate.
